**Vurn Media Photo Rights Terms**

**1. Ownership of Photos:**

All photos created by Vurn Media, whether through employees, contractors, or any affiliated parties, shall remain the sole property of Vurn Media. This includes all intellectual property rights, copyrights, and any other proprietary rights associated with the photos.

**2. Usage and Licensing:**

Vurn Media retains the exclusive right to use, reproduce, distribute, display, modify, and create derivative works from the photos. No third party shall have the right to use, reproduce, distribute, display, modify, or create derivative works from the photos without express written consent from Vurn Media.

**3. Grant of Rights:**

By engaging Vurn Media for photo services, the client acknowledges and grants Vurn Media a non-exclusive, royalty-free, worldwide license to use the photos for promotional, marketing, and other related purposes. However, this grant of rights does not diminish Vurn Media's ownership of the photos.

**4. Client Use:**

The client is granted a limited, non-transferable, non-exclusive license to use the photos solely for the purpose(s) specified in the project agreement. This license is subject to the terms and conditions set forth in this agreement and does not grant the client any ownership rights in the photos.

**5. Unauthorized Use:**

Any use of the photos beyond the scope of the granted licenses without Vurn Media's explicit written consent constitutes a breach of this agreement and may result in legal action to protect Vurn Media's rights.

**6. Attribution:**

Vurn Media shall be credited as the creator of the photos whenever they are used by the client. This credit shall be provided in a format and location agreed upon by both parties.

**7. Confidentiality:**

Both parties acknowledge that the terms of this agreement and any information exchanged during the course of their business relationship are confidential and shall not be disclosed to third parties without written consent.

**8. Termination:**

This agreement and the granted licenses can be terminated by either party upon written notice. Upon termination, the client shall cease using the photos and return or destroy any copies in their possession.

**9. Governing Law:**

This agreement shall be governed by and construed in accordance with the laws of Florida USA, without regard to its conflict of laws principles.

By purchasing this service, the client agrees to the terms outlined in this Photo Rights Terms sheet and acknowledges Vurn Media's ownership and rights to the photos created.

The dimensions for the photos are between 2,000 - 10,000 pixels, 1 - 5MB, and the preferred format is JPEG. This ensures optimal quality for various platforms.

The most common supported aspect ratios include 3:4 (portrait), 4:3 (landscape), and 1:1 (square), catering to different display requirements on various platforms. WTI can also fulfill other sizes if required, but these may be subject to an additional fee.

Requests to retake a photo would be permitted only if the photographer did not fulfill the job according to the specifications indicated in the initial job request. Please include ALL the details of each specific photo job in the NOTES section of the Job Request.

It is solely at the discretion of WTI to decide whether a new photoshoot is warranted.

We offer both lifestyle photos and product photos on a white background. Lifestyle photos capture products in real-life settings, while product photos on white provide a clean and consistent look.

You can expect to receive the photos within 2-4 weeks after we receive the product. This timeframe allows us to ensure high-quality results.

The photos are suitable for use on Amazon, your website, and all social media platforms. This comprehensive coverage ensures your brand's visibility across various online channels.

Additional costs may be required for specific services such as: product assembly, props, oversized items, outdoor photos, night time captures, hand models, full models, and infographics.

If your product requires assembly before photoshoots, there might be an additional cost associated with it. This covers the time and effort needed for proper setup.

Yes, if specific props are required to enhance the photo composition, there may be an additional cost involved.

Oversized items are products that are significantly larger than average and may require special handling or setup during photography. This could incur an extra charge.

Yes, outdoor photos can be arranged, but they may come with an additional cost due to different logistical considerations and lighting requirements.

Certainly, we can provide night-time captures for a unique and dramatic effect. However, this service may come with an additional charge.

If you require a hand model to hold or interact with the product, there may be an extra cost associated with hiring the model and coordinating the shoot.

Absolutely, including a full model in the photos can showcase how the product is used in real-life scenarios. This service might incur an additional fee.

Creating instructional or informational graphics to accompany the product photos may involve extra expenses, depending on the complexity of the graphics.

Adding a note is optional and both WTI admin as well as our photographers will be able to view these notes once the job has been approved. If your product has color / size variations, indicate whether or not the video creator can select their preference. You can specify if you would like your photos to be taken inside / outside, with a person, during the day / night, close-up, with or without its packaging, etc. Do not use the notes section to list product details. Our video creators get familiar with the products by reading product details directly off the Amazon product page, manuals, packaging and by thoroughly using them. WTI admin may also add to or edit your notes when necessary. EXAMPLE NOTE: "Take one close up shot of my picnic blanket to show its stitching, for the other photos please show it being used with a picnic basket of food, family, and or a dog on the blanket, and take all photos outside."
